Business Breakfast for Legal Advisors and Heads of Legal and Finance Departments: Valuation of lost benefits - Pandora's box or conventional calculations?

New year, new challenges...

According to Polish law, reparation of damages includes not only compensation for the losses suffered by the injured entrepreneur. The benefits that the entrepreneur could have achieved if the damage had not been caused to him should also be taken into account.

In the unfavorable situation of incurring damage by the entrepreneur, the key to the success of the process of obtaining compensation is the presentation of a reliable and professional valuation estimating the incurred losses and lost benefits. Most often, the valuation of incurred losses does not pose too many problems for entrepreneurs and their legal advisors. The situation is different for lost benefits.

The valuation of lost benefits differs significantly from a standard estimate of the value of a business or company. A professionally and objectively prepared valuation of lost benefits increases the likelihood of awarding compensation to an entrepreneur, regardless of whether we are dealing with proceedings in common courts or arbitration courts.

Cann Advisory specialists will talk about key aspects of valuation of lost benefits, including the methods used, at the Business Breakfast to be held on March 11, 2020. (Wednesday) at 8:30 a.m., in Warsaw, at Casa Pablo restaurant (5a Grzybowska Street).

During the meeting, experts from Cann Advisory will present the following topics:

  • damage: actual loss vs. lost profits;
  • premises of liability for damages;
  • key issues of estimating lost benefits;
  • predictive methods for determining the hypothetical state;
  • examples, examples, examples...
